Terms and Conditions

Article 1 – Definitions

For the purpose of these General Terms and Conditions, the following definitions apply:

Withdrawal period:
The period during which the consumer may exercise the right to withdraw from the agreement.

Consumer:
A natural person acting outside the scope of their trade, business, or profession who enters into a distance agreement with the entrepreneur.

Day:
A calendar day.

Continuous performance agreement:
A distance agreement relating to a series of products and/or services where delivery and/or purchase obligations extend over a defined period.

Durable data carrier:
Any medium that enables information addressed personally to the consumer or entrepreneur to be stored in a way that allows future consultation and unchanged reproduction.

Right of withdrawal:
The consumer’s right to cancel the agreement within the applicable withdrawal period.

Entrepreneur:
The natural or legal person offering products and/or services to consumers via distance selling.

Distance agreement:
An agreement concluded within an organized distance sales system, whereby exclusive use is made of one or more means of distance communication up to and including the moment the contract is formed.

Means of distance communication:
Any tool used to conclude an agreement without both parties being physically present in the same location.

Article 3 – Applicability

These General Terms and Conditions apply to every offer made by the entrepreneur and to all distance agreements concluded between the entrepreneur and the consumer.

Before entering into a distance agreement, the consumer will have access to these Terms. If direct access is not reasonably possible, the entrepreneur will explain how the Terms can be reviewed electronically and provide them free of charge upon request.

If additional conditions apply to specific products or services, the consumer may rely on the provision most favorable to them in the event of conflicting clauses.

If any provision of these Terms is declared invalid or void, the remaining provisions will remain fully in force. The invalid clause will be replaced by a provision that reflects the original intent as closely as possible.

Article 4 – Offers

Offers that are subject to a specific validity period or particular conditions will clearly state this.

All offers are non-binding. The entrepreneur reserves the right to amend or withdraw any offer at any time.

Each offer contains a clear and accurate description of the products and/or services. Images are intended to represent products faithfully; however, minor variations in color may occur.

Each offer will clearly specify:

  • The price, excluding VAT and import duties

  • Any shipping charges

  • The manner in which the agreement is concluded

  • Whether the right of withdrawal applies

  • Accepted payment and delivery methods

  • The period during which the offer remains valid

  • Any conditions relating to ongoing transactions

Article 5 – Formation of the Agreement

An agreement is formed once the consumer accepts the offer and fulfills all stated conditions.

If acceptance is confirmed electronically by the entrepreneur, the consumer may revoke the agreement until such confirmation has been received.

Article 6 – Right of Withdrawal

Consumers may return non-sale items within 30 days of receipt without providing a reason.

Returned items must be unused, in their original condition, and in their original packaging.

Items purchased during Final Sale promotions with discounts of 40% or more are excluded from returns. This exclusion will be clearly communicated at the time of purchase.

Article 7 – Costs in Case of Withdrawal

If the right of withdrawal is exercised, the consumer is responsible for return shipping costs to the supplier located in China.

After receipt of the returned goods, or valid proof of shipment, the entrepreneur will refund all payments made, including original shipping costs, within 14 days.

Article 8 – Exclusions from Withdrawal

The right of withdrawal does not apply to:

  • Products excluded for hygiene reasons, including earrings or lingerie

  • Items purchased during Final Sale promotions with discounts of 40% or more

Article 9 – Prices

Prices stated in an offer will remain unchanged during the validity period, unless changes are required by law.

Article 10 – Conformity and Warranty

The entrepreneur guarantees that products and services comply with the agreement and meet reasonable expectations of quality, functionality, and durability.

Article 11 – Delivery and Performance

Orders are processed with due care.

If delivery is delayed, the consumer will be informed within a reasonable timeframe.

Article 12 – Payment

Unless otherwise agreed, full payment is required at the time of purchase.

All transactions made through Donna Arnold are governed by these Terms of Service. The entrepreneur reserves the right to correct errors in pricing, product descriptions, or availability without prior notice.

Article 13 – Complaints

Complaints must be submitted in writing.

Article 14 – Governing Law

Donna Arnold is operated by a company registered in the Netherlands. All agreements between the entrepreneur and the consumer are governed by Dutch law.

These Terms are subject to Dutch law unless mandatory consumer protection regulations in the consumer’s country of residence provide otherwise. Statutory rights remain unaffected.

Article 15 – Amendments

The entrepreneur may revise these General Terms and Conditions. Changes will be communicated at least 30 days before taking effect.

Article 16 – Shipping and Return Locations

Donna Arnold works with third-party logistics providers located in China. Orders are therefore shipped from China.

Approved returns must also be sent to China. The applicable return address and instructions will be provided after the return request has been approved.

Questions regarding this process may be submitted upon request.

Article 17 – Legal Disclaimer

The return and exchange policy may be amended at any time without prior notice. Donna Arnold reserves the right to make the final determination regarding return or exchange requests.

Nothing in these Terms limits or excludes rights granted under applicable consumer protection laws. Statutory rights remain fully applicable and may vary depending on the consumer’s country of residence.

Warehouse Clearance Sale

The Warehouse Clearance Sale remains valid until May 15, 2026. After this date, promotional conditions and availability may change or expire automatically.
